1. Agreement and provider
The service is provided by Digital Delmar, located at JEZB2550 Ismail Al Menzi, Al Zahra, Jeddah 23522, Kingdom of Saudi Arabia. By using the website, creating an account, ordering equipment or installation, or using Anees, you agree to these Terms, the Privacy Policy, and any service order or instructions attached to your account.
If you act for a person, family, or organization, you confirm that you have authority to bind them.
2. What Anees is
Anees is a support and reassurance service for older people, using home devices, apps, movement, presence and rest signals, alerts, and audio check-ins where available. Features depend on plan, equipment, region, and launch stage.
Joining the waitlist records interest only. It is not a purchase, reservation, contract, or promise that service will be available in a particular country or by a particular date. A sale begins only through a separately accepted quote or order.
Anees is not an emergency service, a replacement for caregivers or direct checks, or a medical device, diagnosis, or treatment service unless an approved product document expressly says otherwise. Never rely on it alone to protect life or manage an emergency.
3. Eligibility and accounts
You must have legal capacity to create an account or use it under an authorized representative. You are responsible for accurate information, account credentials, and account activity.
Tell us immediately about unauthorized access. We may verify identity or authority before granting access to a care recipient’s information.
4. Household authority and consent
Before installation, obtain all required notices and consents from the care recipient, household owners, residents, and affected visitors. Anees must not be used for covert monitoring or any unlawful purpose.
Caregivers, facilities, and family members may only be added with valid authority and the minimum access their role requires.
5. Ordering, installation, and connectivity
Delivery and installation depend on coverage, availability, and site assessment. You must provide safe access, compatible power and internet, and accurate information about rooms and needs.
Our team may adjust device placement for performance or safety. Do not move, dismantle, obstruct, or tamper with equipment contrary to our instructions.
6. Acceptable use
Use Anees only for lawful care and reassurance.
- Do not access, disrupt, reverse engineer, bypass permissions, or security-test the service without written authorization.
- Do not use the service to spy, harass, discriminate, or make a harmful decision without appropriate human review.
- Do not submit harmful or deceptive material or connect unapproved equipment in a way that creates risk.
- Do not resell, lease, or commercially exploit the service, brand, or outputs without a written agreement.
7. Alerts and human responsibility
Signals depend on installation, connectivity, environment, and available patterns. A signal may be delayed, miss an event, or produce a false alert. Review context and contact the person or caregiver when uncertain.
For an emergency or imminent danger, contact the competent local emergency services immediately. Do not wait for an Anees alert or support response.
8. Audio check-ins
Where available, check-ins are audio-only and do not include video calling. Use them respectfully and with proper authority. You must not record calls without a lawful basis and appropriate notice.
9. Fees, payment, and cancellation
Fees, taxes, equipment ownership, installation, subscription, renewal, cancellation, and refund terms appear in the accepted quote, order, or plan. A specific commercial document prevails over this general paragraph if they conflict.
We will not charge undisclosed fees. Mandatory consumer rights, including those under Saudi e-commerce law, remain unaffected.
10. Availability and changes
We may suspend the service for maintenance, security, faults, or events outside our control. We work to minimize disruption but do not promise uninterrupted or error-free operation.
Features may change for safety, compliance, or performance. If a material change affects a paid service, we will provide any notice or option required by law or contract.
11. Intellectual property
Digital Delmar or its licensors own Anees software, designs, marks, and content. We grant a personal, limited, non-transferable license to use the service during your account term and under these Terms.
Your data remains yours. You grant only the rights needed to process it to deliver, operate, and protect Anees under the Privacy Policy.
12. Suspension and termination
We may suspend access for security risk, unlawful use, unpaid amounts, or material breach, subject to notice and mandatory rights where applicable. You may request account closure through the service process.
On termination, licenses and access end. The Privacy Policy governs retention, deletion, and data availability.
13. Warranty and liability
We provide the service with reasonable care and skill and honor mandatory warranties. To the extent permitted by law, we do not promise that Anees replaces human care or detects every event.
Nothing excludes liability or consumer rights that cannot lawfully be excluded. Otherwise, liability is limited to direct, foreseeable, proven loss under the contract and applicable law, and excludes indirect loss caused by misuse, ignored warnings, or infrastructure controlled by another party.
14. Governing law and disputes
These Terms are governed by the laws of the Kingdom of Saudi Arabia. Please contact Info@ddelmar.ai first so we can try to resolve a dispute. If unresolved, the competent Saudi courts have jurisdiction, subject to any mandatory consumer forum or right.
15. Contact and updates
Contact us at Info@ddelmar.ai or Digital Delmar, located at JEZB2550 Ismail Al Menzi, Al Zahra, Jeddah 23522, Kingdom of Saudi Arabia.
We may update these Terms when services or law change. We will publish the new version and date and request renewed acceptance when legally required. Continued use after a valid effective update constitutes acceptance only to the extent permitted by law.
This operational draft should be reviewed and approved by qualified Saudi counsel before commercial launch.
